Announcement - Rulings on Practice Direction No. 17
28 February 2006
This
Practice Direction
became effective from 9th January 2006. The practice direction sets out a case management regime that is designed to ensure that unfair dismissal matters are brought before the Commission expeditiously.
A number of applications have come before the Commission where parties have sought to vary directions (paragraph 12), have failed to comply with directions or where a party was seeking the vacation of the hearing date (paragraph 13).
The following judgments have recently been published to the Commission's CaseLaw website:
Zammit and KTS Logistics Pty Ltd [2006] NSWIRComm 36
Gu v Nature's Care Manufacture Pty Ltd [2006] NSWIRComm 39
Dedov and Apollo Life Sciences Ltd [2006] NSWIRComm 55
As will be noted from the judgments the Commission's approach is one in which the case management regime will be strictly enforced.
