Announcement - Arrangement of Business During 2007-08 Law Vacation.

The 2007 law vacation commences from close of business on Friday 14 December 2007.

In line with previous years the Commission will have in place arrangements to ensure that matters are dealt with in a timely way:

  • the usual arrangements for a duty judge to be on duty and in attendance at the Commission during the entire period of the law vacation (that is, 17 December 2007 to 25 January 2008) will be in place
  • the usual arrangements for a duty commissioner to be on duty for the period 24 December 2007 - 9 January 2008 will remain in place with all Commissioners on duty from 10 January 2008.
  • in the event that any urgent matter arises that requires one or more of the judicial Members of the Commission to be available to sit arrangements will be made to allow that to occur.

During the course of the law vacation arrangements will be in place to ensure that
  • unfair dismissal matters continue to be listed to meet the standard time to first listing/conciliation of 21 days
  • industrial disputes can be listed before a member of the Commission immediately, and
  • any urgent notices of motion or similar matters may be listed where appropriate before a judicial member immediately

Additionally, the Commission is prepared to hold hearings before Presidential Members during January 2008 subject to the availability of litigants and their representatives. Should any party be desirous of having their matter heard during January 2008 a written request giving full details of the matter should be forwarded to the Industrial Registrar no later than Friday, 2 November 2007.

Expedition
Practitioners and other users of the Commission are reminded of the provisions under the Commission's Rulesto seek expedition in a particular matter or that a matter be determined urgently.

Rule 16 of the Industrial Relations Commissions Rules 1996 states
      (1) An applicant who desires that any matter should be dealt with as one of urgency must file an affidavit setting out, briefly but specifically, the reasons for the request.
        (2) A copy of the affidavit must be served with the originating process or, if the proceedings before the tribunal have already commenced at the time of filing the affidavit, it must promptly be served on each of the other parties.


    The 2008 law term commences on Tuesday 29 January 2008.
