Announcement - Change to Industrial Relations Commission Rules

From 1st February 2010 the Commission (including the Court) will be transitioning to the Uniform Civil Procedure regime that currently operates in the Supreme, Land and Environment, District and Local Courts.

In effect this will mean that much of the procedure before the Commission will be determined by reference to the Uniform Civil Procedure Rules 2005, however, there will be 'local rules' which prevail - these will be known as the Industrial Relations Commission Rules 2009.

Note in relation to forms:

The Commission is currently reviewing forms with a view to utilising, as far as possible or practicable, prescribed forms under the Uniform Civil Procedure Rules. Pending that review, files currently available on the Commission's website should continue to be used. Click here for those forms.

Note in relation to Practice Directions.

Current practice directions will be re-issued as Practice Notes under the relevant provisions of the Civil Procedure Act 2005 or the Industrial Relations Act 1996 following the commencement of the new rules regime. A further announcement will be placed on our website with a link to the new Practice Notes on 1 February 2010.
