Announcement - Amendment to Oaths Act - Confirming identities for affidavits and statutory declarations

From 30 April 2012an amendment to section 34 of the Oaths Act 1900 commenced. A new Oaths Regulation 2011also commenced. The legislation imposes additional obligations on justices of the peace or other prescribed witnesses for identifying a person before witnessing a NSW statutory declaration or affidavit.

The purpose of the amendment is to confirm the identity of a person making a NSW statutory declaration or affidavit. From 30 April 2012, any person witnessing a NSW statutory declaration or affidavit MUST take additional steps to confirm the identity of the person making the statutory declaration or affidavit. The witness MUST ALSO endorse the document with a certificate per section 34(1)(c), Oath's Act 1900.
