Announcement - Practice Direction No. 12: New Case Management Standards for OH&S Prosecutions

The Commission has published a practice direction designed to facilitate the effective case management of prosecutions brought before the Commission in Court Session under the Occupational Health and Safety Act 2000.

The Practice Direction was published on 24th October 2003 and will become effective from 7th November 2003.

Practice Direction 12 prescribes standard directions and timetables for such matters and, as far as practicable, is designed to ensure that they are dealt with in an orderly and expeditious manner.

The Practice Direction provides for

  • initiating documentation to be served on the defendant
  • the filing of a Notice of Appearance by defendants or their representative
  • the service of the Brief of Evidence
  • what is to occur at the First Direction Hearing
  • procedures for the entry of pleas
and other ancillary matters.

It is the intention of the Commission to monitor the application of the Practice Direction with a view to refining or amending if necessary. Any comments may be forwarded to the Industrial Registrar DX 874 Sydney or by email to nswirc@agd.nsw.gov.au
