Announcement - Practice Direction No 14 - New Case Management Standards for s106 Harsh Contract Matters

The Commission has published a practice direction designed to facilitate the effective case management of applications brought in respect of s.106 of the Industrial Relations Act 1996 .

Practice Direction No 14 prescribes standard directions and timetables for such matters at both the pre and post conciliation phases and, as far as practicable, is designed to ensure that matters are dealt with in an orderly and expeditious manner.

The Practice Direction provides for

    • standard directions for conciliation under s109 of the Act
    • pre-hearing standard directions in the event of an unsuccessful conciliation
    • certification that the matter is ready for hearing

and other ancillary matters.

Practice Direction No 14 will take effect from 2nd July 2004.
