Announcement - Arrangement of business during 2009-10 law vacation

The 2009 law vacation commences from close of business on Friday 18 December 2009.

In line with previous years the Commission will have in place arrangements to ensure that matters are dealt with in a timely way:

  • the usual arrangements for a duty judge to be on duty and in attendance at the Commission during the entire period of the law vacation (that is, 18 December 2009 to 29 January 2010) will be in place
  • the usual arrangements for a duty commissioner to be on duty for the period 28 December 2009 - 8 January 2010 will remain in place with all Commissioners on duty from 11 January 2010.
  • in the event that any urgent matter arises that requires one or more of the judicial Members of the Commission to be available to sit arrangements will be made to allow that to occur.

During the course of the law vacation arrangements will be in place to ensure that
  • unfair dismissal matters continue to be listed to meet the standard time to first listing/conciliation of 21 days
  • industrial disputes can be listed before a member of the Commission immediately, and
  • any urgent notices of motion or similar matters may be listed where appropriate before a judicial member immediately

Practitioners and other users of the Commission are reminded of the provisions under the Commission's Rules to seek expedition in a particular matter or that a matter be determined urgently.

Rule 16 of the Industrial Relations Commissions Rules 1996 states
    (1) An applicant who desires that any matter should be dealt with as one of urgency must file an affidavit setting out, briefly but specifically, the reasons for the request.

    (2) A copy of the affidavit must be served with the originating process or, if the proceedings before the tribunal have already commenced at the time of filing the affidavit, it must promptly be served on each of the other parties.

The 2010 law term commences on Monday 1 February 2010.
